Staff Attorney Positions—Office of the Attorney General
Department on Disability Services: Office of the General Counsel
The District of Columbia Office of the Attorney General (OAG), Office of the General Counsel for the District of Columbia Department on Disability Services (Agency) seeks an attorney with a background in disability law and administrative litigation.
The District of Columbia Department on Disability Services, a newly created agency, includes two administrations: the Developmental Disabilities Administration (DDA) and the Rehabilitation Services Administration (RSA). The Developmental Disabilities Administration provides oversight and coordination of all services and supports provided to qualified persons with development disabilities in the District of Columbia. The Rehabilitation Services Administration provides comprehensive vocational and independent living services to persons with disabilities to promote their opportunities for employment, economic self-sufficiency and independence, and administers the Blind Vendor Facilities Randolph-Sheppard Program. This position is located at 1125 15th Street N.W.
The successful candidate will serve under the direct supervision of the General Counsel and Deputy General Counsel. The successful candidate will represent the Department before the Office of Administrative Hearings in fair hearing requests filed under the Rehabilitation Act and the Social Security Act, and advise counselors in legal matters related to provision of services. The attorney-advisor will assist the Department in adjudicatory and quasi-adjudicatory proceedings, providing litigation support as needed. The successful candidate will perform other legal duties in support of the Department’s mission.
The successful candidate will have experience in disability law, knowledge of the Rehabilitation Act and the Social Security Act, or a strong interest in developing legal expertise in disability law. Experience in administrative and/or civil litigation is desired. Knowledge of administrative law is required. Candidates must possess excellent writing skills, ability to multi-task and meet constantly changing deadlines under exacting time demands, and possess good people skills. Successful candidate must possess excellent writing and analytical skills, especially the ability to prepare documents for submission to administrative tribunals and letters of legal advice. Successful candidate must possess highly developed oral communications skill, including the ability to represent the agency before administrative tribunals, and provide oral legal advice.
The successful candidate must have a law degree and be a member of the District of Columbia Bar or eligible for waiver into the bar. Candidates for the position may be subject to a background check. This position is within the collective bargaining agreement.

Department of Corrections: Office of the Attorney General - Attorney Advisor
The Office of the Attorney General for the District of Columbia is seeking candidates for the position of Attorney-Advisor for the District of Columbia Department of Corrections (DOC). The DOC provides public safety by ensuring the safe, secure, and humane confinement of pretrial detainees and sentenced misdemeanant prisoners.
The Attorney-Advisor will provide legal advice regarding issues affecting the agency and its programs. The Attorney-Advisor will primarily facilitate responses to discovery requests and subpoenas from the Office of the Attorney General Civil Litigation Division, the U.S. Attorney’s Office and Department of Justice, the U.S. Marshals Service, the local and federal public defenders service and private defense bar. The Attorney Advisor will also provide legal assistance and advice on personnel matters, draft and review contracts, memoranda of understanding, intergovernmental agreements, and analyze and advise on local and federal case law, statutes and court orders. The Attorney may draft proposed legislation and rules and will provide legal assistance to the General Counsel on such matters.
The successful candidate must have a law degree and be a member of the District of Columbia Bar or eligible for waiver into the bar. The candidate must also have a working knowledge of the operations of the District government; effective interpersonal skills, and excellent oral and written communication skills and litigation skills; and a demonstrated knowledge of the federal and District public laws, including: Chapter 16 of the DCMR and other Personnel laws and regulations, Title 24 of the DC Official Code (“Prisoners and their Treatment”), the Legal Service Establishment Amendment Act of 1998, and District of Columbia law pertaining to procurement and personnel.
Candidates for this position shall be subject to drug testing and a criminal background check. This position is outside the Collective Bargaining Unit.

District of Columbia Public Schools: Office of the General Counsel - Attorney Advisor
This position is located in the Office of the General Counsel (OGC), D.C. Public Schools (DCPS) serving as an Attorney-Advisor in providing legal guidance and rendering opinions for DCPS in the area of special education by facilitating legal compliance with the requirements of the Individuals with Disabilities Education Improvement Act of 2004 (IDEIA). This office helps ensure that DCPS meets the needs of their students in a fair and consistent nature.
The candidate must have knowledge and ability to provide a full range of legal advice and litigation services related to special education and the IDEIA; Knowledge and ability to serve as an Attorney-Advisor on highly complex legal issues, making substantive, programic, and administrative recommendations, and ability to make effective oral presentations in a clear and concise manner and demonstrated skill in preparing well-written, organized and persuasive legal documents.
The successful candidate must be a member of the District of Columbia Bar or eligible for waiver into the bar; also have excellent oral and written communication skills; and must have at least one year of experience in handling labor relations matters; the successful candidate must have a high level of technical legal knowledge of the full range of applicable DCPS, District of Columbia, and federal legal statues, codes and procedures in order to provide legal and quasi-legal services to the General Counsel, supervisor, DCPS administrative staff, and the Chancellor. The successful candidate must have a high level of familiarity with the Title 31 of the District of Columbia Code and D.C. Court Rules, Chapter 30 of the District of Columbia Municipal Regulations (DCMR), IDEIA, the Federal Educational Records and Privacy Act (FERPA), Section 504 of the Vocational Rehabilitation Act of 1973, the American’s With Disabilities Act of 1990 (ADA), the Elementary and Secondary Education Act of 1965(ESEA) (20 USC 6300 et. seq.), the No Child Left Behind Act of 2001, and the Freedom of Information Act.

Family Services Division: Child Protection Section
The Office of the Attorney General for the District of Columbia is seeking a Trial Attorney for a position within the Family Services Division, Child Protection Section.
Attorneys in the Child Protection Sections represent the Child and Family Services Agency (CFSA) in the approximately 2500 open child abuse and neglect cases in the Family Court of the D.C. Superior Court. There are four Child Protection Sections. One of these sections specializes in litigating termination of parental rights (TPR) cases and providing assistance in adoption matters when necessary. Attorneys in the other three sections handle all other aspects of child neglect litigation on behalf of the District and CFSA including petitioning new cases alleging child abuse or neglect, propounding and/ort responding to discovery, filing and/or responding to pre-trial motions, participating in mediation, preparing witnesses to testify at trial, and presenting evidence at trial. The attorneys’ representation continues post-adjudication with the goal of ultimately securing a safe and permanent home for children through reunification, adoption or guardianship. In the post-adjudication phase of a neglect case, attorneys are responsible for representing CFSA at regular permanency and review hearings, participating in occasional evidentiary hearings, filing motions and responsive pleadings, advising and counseling social workers and other professionals from CFSA, participating in clinical staffing and administrative reviews, and working with various multi-disciplinary team members. Attorneys maintain a relatively small trial caseload and a larger post-adjudication caseload. Attorneys are in court approximately 50% of their time.
The successful candidate must have a law degree and be a member of the District of Columbia Bar or eligible for waiver into the bar. The candidate should also have a demonstrated commitment to work in the area of child protection or family law issues. Litigation experience is preferred, but not required. The positions are at the LS-11 to LS-13 level, depending on experience.

Department on Human Resources: Office of the General Counsel
The Office of the Attorney General is seeking an Attorney-Advisor for the Office of the General Counsel in the DC Department of Human Resources (DCHR). DCHR administers the human resource management program for subordinate agencies to ensure that the District government attracts, develops and retains a well-qualified, diverse workforce in compliance with the Comprehensive Merit Personnel Act and other relevant District and federal laws, rules, and regulations. The Office of the General Counsel provides legal advice to the Director, DCHR, and agency management on a variety of complex legal issues in order to effectuate DCHR’S mission. The Office of General Counsel provides legal advice and guidance to both subordinate and independent agencies within the District government regarding matters involving personnel and employment law.
Specific responsibilities of the Attorney-Advisor will include but shall not be limited to: Serving as attorney to the Police and Firefighters Retirement and Relief Board (Board), an adjudication board under DCHR responsible for determining eligibility for retirement, disability and related matters for District police and firefighters, US Park Police and US Secret Service and their survivors; Representing the Board at hearings and writes recommended decisions determining eligibility for retirement and/or disability benefits; Providing expert legal advice in the area of retirement and disability benefits to the Board, attorneys, and doctors on the Police and Firefighter’s Retirement and Disability Act and other related District and federal employment-related laws; Serving as Litigation Coordinator for the Board on appeals of Board decisions to the DC Court of Appeals; Assisting the General Counsel for DCHR in providing legal advice to the Director, DCHR, as well as carrying out other legal tasks that may be required for DCHR, and assisting OAG and Office of Labor Relations and Collective Bargaining in preparing cases for litigation before courts and administrative tribunals; Reviewing and analyzing, for legal soundness and accuracy, various documents including legislation, regulations, memoranda of agreement, FOIA responses, and proposed notices for corrective and adverse actions; Drafting legislation and rulemaking related to DCHR mission and functions; and Keeping abreast of legal, administrative and other changes and interpretations regarding laws and regulations related to the functions of DCHR.
The successful candidate must have a law degree and must either be a member of or eligible for waiver into the District of Columbia Bar. If a candidate is selected and is not a member of the District of Columbia Bar, he/she must apply for membership and show proof such application prior to commencement of employment. The candidate must also have a working knowledge of laws related to retirement and disability benefits, the operations of the District government, effective interpersonal skills and excellent oral and written communication skills. Experience in employment law, labor law or labor relations, and legislative drafting or rulemaking a plus.
