Attorney General and Agency Counsel 

 
 
Equity Litigation Chief:  Civil Litigation Division

 The Civil Litigation Division of the Office of the Attorney General for the District of Columbia is seeking a Chief for Equity Section I (“EQI”).  EQI defends the District of Columbia and its officials and employees in complex civil litigation seeking injunctive and other relief that impacts substantially on executive level agencies.  This includes class action and other systemic challenges to the services, practices, conditions and/or care provided by District agencies and departments, and/or challenges to their component operations; civil actions seeking to enjoin enforcement of or otherwise challenge any District laws; and civil actions concerning a variety of regulatory actions taken by District agencies.  These cases vary from individual to class action complaints and from singular to system-wide challenges.  EQI also advises a number of District agencies on matters related to pending litigation and/or matters in which orders awarding permanent injunctive relief have been entered.           

 The EQI Chief’s duties include, but are not limited to:

  • Supervising 11 Assistant Attorneys General (“AAG”) in all aspects of civil litigation in the United States District Court for the District of Columbia and the Superior Court of the District of Columbia; 
  • Ensuring proper case assignment and case transfers to and coverage by AAGs to meet  court, mediation, and other schedules or deadlines; 
  • Reviewing and approving pleadings, motions, memoranda, discovery, and correspondence; 
  • Evaluating cases for settlement purposes and authorizing or recommending settlement amounts; 
  • Monitoring compliance of AAGs and staff with the Attorney General’s Performance Contract requirements, including response to contacts within 24 hours and successful litigation outcome rates. 
  • Reviewing litigation outcomes and make timely recommendation where appellate review is needed; 
  • Attending management meetings with the Deputy and Office of the Attorney General as requested, as well as attend such management and other specific meetings with District agencies, their units, or personnel as necessary or requested; 
  • Assisting in interviewing, reviewing, evaluating, and, where necessary, disciplining AAGs, in accord with D.C. Rule of Professional Conduct and OAG standards and policies. 
  • Maintaining requisite legal, management, inter-agency, human relations, and management-labor knowledge and skills; and 
  • Collecting, maintaining, and disseminating timely, accurate and up-to-date data on the Section’s activities. 
 The successful candidate must have a law degree and must either be a member of or eligible for waiver into the District of Columbia Bar.  If a candidate is selected and is not a member of the District of Columbia Bar, he/she must apply for membership and show proof of such prior to the commencement of employment.  The candidate must also have considerable prior experience handling complex civil litigation, including class action, constitutional, and § 1983 litigation, particularly cases that seek a broad range of injunctive relief, as well as prior managerial experience, and excellent writing skills.

General Counsel:  Department of Consumer and Regulatory Affairs
The Office of the Attorney General for the District of Columbia is seeking candidates for the position of General Counsel at the District of Columbia Department of Consumer and Regulatory Affairs (DCRA).  DCRA is the District of Columbia's regulatory agency.  Through its licensing, inspection, compliance, and enforcement programs, DCRA regulates business activities, land and building use, construction safety, historic preservation, rental housing and real estate, and occupational and professional conduct within the District.  DCRA takes legal action against businesses and individuals who violate District laws, and works to prevent the occurrence of illegal, deceptive, and unfair trade practices through education and public awareness programs.
 
The Office of the General Counsel (OGC) for DCRA provides legal support for the agency's three operating administrations and several administrative support offices within DCRA.  In addition, OGC provides legal support to numerous occupational and regulatory boards and litigation support to OAG's litigating units in cases involving DCRA.
 
The General Counsel is responsible for overseeing the legal matters affecting the agency and its programs and managing the attorneys and staff within the OGC.  The duties of the General Counsel also include:  (1) drafting legislation, regulations and Council testimony, and District government agency reports to the Mayor, (2) negotiating and drafting memoranda of understanding with other District agencies, (3) participating in meetings with Council members and staff and officials in the Executive Office of the Mayor, (4) assisting and advising DCRA’s senior management team on various agency legal issues, and (5) managing the agency’s handling of risk management issues, FOIA requests, and agency performance management issues. 
 
The successful candidate for this position must be barred in the District of Columbia or eligible for waiver into the D.C. Bar.  The candidate should also have a working knowledge of the operations of the District government; in-depth knowledge of the relevant laws that DCRA is charged to enforce, or experience with similar statutory schemes elsewhere; knowledge of District of Columbia law pertaining to procurement and personnel; and prior management experience.  In addition, the candidate must have excellent interpersonal skills; outstanding oral and written communication skills and litigation skills; and the ability to learn new areas of law quickly.  The selected candidate must be a resident of the District of Columbia, or must move into the District within 6 months of appointment and remain a District resident as long as he/she holds the position.

General Counsel:  Department of Small and Local Business Development

The Office of the Attorney General for the District of Columbia is seeking a General Counsel for the Department of Small and Local Business Development (DSLBD).  The mission of the DSLBD is to foster economic growth and development of local, small and disadvantaged business enterprises through supportive legislation, business development programs, agency and public/private contract compliance.
 
The General Counsel for the DSLBD will provide critical legal support to the Director and the Department. The substantive areas of responsibility of the GC include providing legal advice on issues ranging from administrative law to procurement or contract law or rules, legislative analysis, monitoring legislative developments and ensuring legal sufficiency, drafting legislation and regulations, and providing agency support in consultation with the Office of the Attorney General (OAG) on certification protests, hearings and reevaluations and compliance enforcement.
 
The successful candidate must have a law degree and be a member of the District of Columbia Bar or eligible for waiver into the bar.  If a candidate is selected and is not a member of the District of Columbia Bar, he/she must apply for membership and show proof of such prior to the commencement of employment.  The candidate must also have at least five (5) years of prior experience in contract law, an in-depth knowledge of generally applicable contract/procurement statutes and regulations and of the procurement/contracting process, strong legal research and writing skills, and excellent interpersonal skills.  In addition, the candidate must have the skill and ability to gather, develop, evaluate and analyze investigative information from a variety of sources to determine compliance with District government and federal statutes, rules and regulations.  Subject matter experience in the areas economic development and local, small and disadvantaged businesses is highly desirable.
 
The position is an at-will appointment by the Attorney General of the District of Columbia, made in consultation with the Director of DSLBD.  The selected candidate is required to be a resident of the District of Columbia within 6 months of appointment.  This position is outside the Collective Bargaining Unit. General Counsel:  Office of Public Education Facilities Modernization

This position is located in the Office of the General Counsel (OGC), Office of Public Education Facilities Modernization (OPEFM).  The Office of Public Education Facilities Modernization (OPEFM) was created by the historic DC Education Reform Act of 2007 to undertake large scale capital projects as well as the construction and modernization of DC Public School facilities. The estimated cost of the 15-year modernization campaign is approximately $3.5 billion. The office also will now manage all maintenance for the school system. The DC City Council approved the Mayor's school reform legislation that included the creation of this independent entity within city government that has its own contracting, legal and financial operations to speed necessary reforms. Since its inception in June 2007, OPEFM has moved quickly to create a start-up operation based on a private sector management model. In preparation for the start of the FY07-08 school year OPEFM managed summer repair initiatives and is in the process of assessing and reorganizing the various new construction and ongoing modernization projects.

The Deputy General Counsel (DGC) will work under the direction of the General Counsel. The DGC will have responsibility to assist with facilitating legal compliance, and ensuring that OPEFM acts in compliance with its statues, regulations, and other applicable laws and regulations; assist with planning, organizing, and providing direct professional legal counsel and representation for OPEFM staff.

As the Deputy General Counsel the candidate will provide legal services on a broad array of legal issues, serves as a legal advisor to OPEFM staff and support the OGC; the candidate will also serve as the principal advisor for OPEFM on all legal matters and be responsible for overseeing all legal services.  Assists the General Counsel in managing the overall operations of the office and the direction of all OPEFM activities and matters.  Represents OPEFM and General Counsel at hearings, conferences, media events, school based events and other activities deemed appropriate by the OPEFM director.

Candidates must be able to work with minimal supervision, meet constantly changing deadlines under exacting time demands; In addition, successful candidates must possess excellent writing and analytical skills, and ability to multi-task; possess good people skills.  Successful candidate must also possess good leadership skills, and have the ability to assist in managing projects; excellent organizational skills; candidates should have prior contract experience, knowledge of FOIA; In addition, successful candidate should have the ability to work with extremely complex and difficult legal questions and issues that involves drafting interpretation(s) or application of legislation, regulations, contracts, court decisions or other legal instruments.  Successful candidate must also have the skill in oral communications, including the ability to represent the agency before administrative tribunals, and provide oral legal advice.

Deputy Attorney General:  Commercial Division

The District of Columbia Office of the Attorney General (OAG) is seeking a Deputy Attorney General to lead the Commercial Division.  The Commercial Division includes the following sections: Economic Development; Land Use and Public Works; Procurement; Real Estate; and Tax, Bankruptcy and Finance.

The Attorney General operates under the authority of DC Official Code § 1-301.111, which provides: The Office of the Attorney General shall be under the direction of the Mayor, and have charge and conduct of all law business of the said District, and all suits instituted by and against the government thereof. He or She shall furnish opinions in writing to the Mayor, whenever requested to do so. All requests for opinions shall be transmitted through the Mayor, and a record thereof kept, with the opinions, in the Office of the Executive Secretary of the Mayor. He or She shall perform such other professional duties as may be required of him by the Mayor.

The Office of the Attorney General is structured much like a private law firm, with sections devoted to specialties. Some 250 employees serve as legal assistants, secretaries, investigators, and other professional staff. The legal staff numbers approximately 340 lawyers. Currently, the Office of the Attorney General consists of eleven (11) major divisions with specialty sections.

The Deputy Attorney General participates in the development and evaluation of the legal programs and systems of service delivery.  In the absence of the Attorney General, the Deputy Attorney General appears before Congressional and D. C. Council committees on matters relating to the responsibilities of the Division. 

The successful candidate must have a law degree and must either be a member of or eligible for waiver into the District of Columbia Bar. If a candidate is selected and is not a member of the District of Columbia Bar, he/she must apply for membership and show proof of such prior to the commencement of employment.  The ideal candidate will also have more than 10 years of legal experience with at least 5 of those years in a supervisory role.  The selected candidate must possess strong management experience, people skills and the ability to multitask.  A strong competency in the areas of Economic Development, Land Use, Real Estate and Finance is also required.

The annual salary for this position will not exceed $155,600.
